Terms of use - please read carefully

The discussion area is a service provided and facilitated by Disqus inc. (“Disqus”) and not us. Please note that you will be providing Disqus with your data and that Disqus will determine how to deal with your data including without limitation where it may be processed and what it may be used for (e.g. marketing). By proceeding you accept that:

It is important that you read them as they include important information relating to the Discussions including disclaimers and limitations on our liability. These terms of use apply to all visitors to and users of the Discussions. By using the Discussions, you confirm that you accept these terms of use and that you agree to comply with them. These terms of use supplement any other terms that apply to use of our website or the Discussions along with any terms imposed by Disqus (including Disqus’ privacy policy).  If you do not agree to these terms of use or any terms imposed by Disqus, you must not use the discussions area.

CO-OPERATIVE GROUP LIMITED, is a registered society under registration number 525R whose registered office is at 1 Angel Square, Manchester, M60 0AG (“we” or “us” or “our” as the context requires). References we make to “our group” are to our group of companies and registered societies which includes, but is not limited to, Co-operative Group Food Limited and Funeral Services Limited.

    1. Please remember that any comments you make are in the public domain and can be seen by anyone and may be accessible forever. Don’t forget that you are legally responsible for anything you submit.

    1. These Discussions allow our members and other users to interact. Any views expressed are not our views and we do not endorse any postings. You follow any advice, guidance or recommendations provided by other users at your own risk.
    2. To the maximum extent permitted by law, we and each member of our group accept no liability (whether foreseeable or not), assume no responsibility and disclaim all liability to you and any other person or entity relating to use of, or reliance on the Discussions or any content posted thereon  whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising out of or in connection with the Discussions including, for the avoidance of doubt and without limitation: any direct, indirect or consequential losses; loss of or damage to goodwill; losses arising from breach of any applicable law, regulation, legislation, regulatory code, rule or order; or any other losses, liabilities, costs (including legal costs), charges, claims, actions, procedures, demands, damages, fines or expenses suffered or incurred.
    3. Nothing in this disclaimer excludes or limits liability which cannot be limited or excluded by law. In particular but without limitation, nothing contained herein shall be deemed to exclude: (i) death or personal injury caused by negligence; or (ii) fraud or fraudulent misrepresentation.
    4. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Discussions, any content on them or your use of them whether express or implied.
    5. The Discussions must not be used for commercial purposes or for private gain. All postings must be relevant to us or to the theme of the relevant discussion.
    6. Any commercial postings or advertising, or links which direct traffic to your own sites are not permitted and will be removed.
    7. We do not guarantee that the Discussions will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access the Discussions and you should use your own virus protection software.
  5. Prohibited uses
    1. You may use the Discussions for lawful purposes only. You may not use the Discussions:
      1. in any way that breaches any applicable local, national or international law or regulation;
      2. in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
      3. to disclose private, personal; or confidential information;
      4. for the purpose of harming or attempting to harm minors in any way;
      5. to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards – see below;
      6. to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
      7. to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
    2. You also agree:
      1. not to reproduce, duplicate, copy or re-sell any part of the Discussions;
      2. not to access without authority, interfere with, damage or disrupt:
        1. any part of our site or the Discussions;
        2. any equipment or network on which our site or the Discussions are stored; 
        3. any software used in the provision of our site or the Discussions; or 
        4. any equipment or network or software owned or used by any third party.
  6. Content standards
    1. These content standards apply to any and all material which you contribute to any of the Discussions (“contributions”), and to any interactive services associated with them.
      You must comply with the spirit and the letter of the following standards. The standards apply to each part of any contribution as well as to its whole.
    2. Contributions must:
      1. be accurate (where they state facts);
      2. be genuinely held (where they state opinions); and
      3. comply with applicable law in the UK and in any country from which they are posted.
    3. Contributions must not:
      1. contain any material which is defamatory of any person;
      2. contain any material which is obscene, offensive, hateful or inflammatory;
      3. promote sexually explicit material;
      4. promote violence;
      5. promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
      6. infringe any copyright, database right or trade mark of any other person;
      7. be likely to deceive or mislead any person;
      8. be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
      9. promote any illegal activity;
      10. be threatening, abusive or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
      11. be likely to harass, upset, embarrass, alarm or annoy any other person;
      12. be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
      13. give the impression that they emanate from us, if this is not the case; or
      14. advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
    4. Spamming repeatedly with the same point deters others from engaging and will not be tolerated.
  7. Confidential information
    1. Remember to keep your confidential and personal information safe and don’t post the same on the Discussions. By way of example, don’t make public your phone number, address or other personal details.
  8. TERMINATION Suspension and termination
    1. We will determine, in our discretion, whether there has been a breach of these terms of use through your use of the Discussions.  When a breach of these terms of use has occurred, or as we otherwise reasonably require, we may take such action as we deem appropriate.
    2. Failure to comply with these terms of use constitutes a material breach of the terms upon which you are permitted to use the Discussions and may result in our taking all or any of the following actions:
      1. immediate, temporary or permanent withdrawal of your right to use the Discussions;
      2. immediate, temporary or permanent removal of any posting or material uploaded by you to the Discussions;
      3. issue of a warning to you;
    3. We exclude liability for actions taken in response to breaches of these terms of use.  The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.
  9. Use by minors
    1. The use of any of our Discussions by a minor is subject to the consent of their parent or guardian. We advise parents who permit their children to use an interactive service that it is important that they communicate with their children about their safety online, as moderation is not foolproof. Minors who are using any interactive service should be made aware of the potential risks to them.
  10. What to do if you have concerns 
    1. If you have any concerns regarding any content on the Discussions you can report the same by flagging it as inappropriate using the 'flag as inappropriate' link next to the post or emailing social@co-operative.coop
    2. We are under no obligation to oversee, monitor or moderate any interactive services, and we expressly exclude our liability for any loss or damage arising from the use of any Discussions by a user in contravention of our content standards.
    3. We do not want to become embroiled in disputes between users, nor do we want the Discussions to be used to host any content that anyone considers to be defamatory. As such, we are likely to remove any contributions you make without contacting you if we receive a notice alleging the contributions are defamatory or otherwise infringe someone’s rights.
    4. Where you flag any comment as being inappropriate, we will review the same and consider whether it should be removed.
  11. Changes to these terms of use
    1. We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.
  12. Publishing materials
    1. If you upload onto any of the Discussions, or in any other way publish on any of the Discussions, any materials, you warrant that you have all permissions to do so.
    2. We will be entitled to use any such materials which you upload onto any of the Discussions for the purposes we reasonably require. Materials shall mean any information, text, graphics, photos and any other data. We may also use any ideas or concepts.
  13. Termination
    1. We have no obligation to make the Discussions available or to continue to do so. We may terminate the Discussions at any time without any liability or requirement to provide notice.
  14. Applicable law 
    1. These terms of use shall be governed by and construed in accordance with English law and you and we hereby submit to the exclusive jurisdiction of the English courts in respect of any dispute or matter arising out of or connected with these terms of use.
