Terms and Conditions

By entering the Promotion you confirm that you have read, understood and agreed to these terms and conditions (the ‘Terms and Conditions’).

1 - Eligibility:

This promotion is only open to UK residents aged 18 years or over. Employees of the Promoter (or any of its group undertakings and its agencies who are directly connected with the creation and administration of this promotion) are excluded from entering.

2 - How to enter:

2.1. Purchase a copy of the Guardian or the Observer newspaper and scan your Co-op membership card in a Co-operative Group Food store during the Promotional Period. Temporary membership card holders are automatically excluded from this promotion.

2.2. In-store purchase necessary. Only one entry per person per day.

3 - Promotional Period:

The Promotional period will run from 00:00 on the 04/12/2024 and will finish at 23:59 on the 27/12/2024.

4 - Prizes:

4.1. One winner will receive a £500 Co-op Gift card.  Five additional winners will each win a £100 Co-op Gift card.

4.2. The Prizes are as stated, non-transferable and no cash alternative is available.

4.3. The Promoter accepts no responsibility for any costs associated with the Prizes that are not expressly included in the prize description.

5 - Winner announcement/ Prize claim:

5.1. There will be 6 Winners in total.

5.2. The Winners of the Prizes will be drawn by The Co-op at random via a secure, entirely automated independently verified computer system from all eligible entries. The first selected Winner will win a £500 Co-op Gift card. The next five selected Winners will win a £100 Co-op Gift card. The Winners will be notified by The Co-op via email within TWO (2) weeks of the end of the Promotional Period. Co-op will use the email address registered on each winner's Co-op membership account to notify them. The Winner may withdraw from the promotion by responding “opt-out” within 48 hours of receiving the notification email. Co-op will pass the winner's email address to the Promoter so the Promoter can contact the winner via email to organise the prize fulfilment.

5.3. The Winner of the Prize must respond within two (2) business days of being notified by Co-op. If the Winner does not respond within such timeframe, then the Winner's Prize will be forfeited and Co-op shall be entitled to select another winner in accordance with the process described above. If a Winner rejects their Prize or the entry is in breach of these Terms and Conditions, the Winner's Prize will be forfeited and Co-op shall be entitled to select another Winner.

5.4. The surname and county of residence of the Winners can be obtained after 25 January 2025 by sending a stamped addressed envelope to the following address: Head of Print Strategy and Performance, Publishing, Guardian News & Media Limited, Kings Place, 90 York Way, London N1 9GU.

6 - Privacy and Data Protection:

6.1. Personal data received in the course of the Promotion will be used in accordance with applicable data protection law and in accordance with the Co-op’s Privacy Policy: https://www.coop.co.uk/terms/privacy-notice and the Promoter’s Privacy Policy: https://www.theguardian.com/help/privacy-policy. By participating in the Promotion you consent to the Co-Op and the Promoter processing your personal data for the purposes of carrying out the promotion and notifying and identifying the Winners. 

6.2. The Promoter intends to make available the surname and county of residence of the Winners, and for the purposes outlined in paragraph 5.4 above. If you do not wish your surname and/or county of residence to be made available for this purpose then please notify us by no later than 29 December 2024 by sending an email to georgia.easteal@theguardian.com with “The Co-op / Guardian and Observer Prize Draw” in the subject line.

7 - General:

7.1. The Promoter reserves the right, in exceptional circumstances, to award an alternative prize of equal or greater value, should one or more of the Prizes (or any element of it) become unavailable for any reason.

7.2. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this Promotion or the awarding of the Prizes, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the Promotion or these Terms and Conditions, at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.

7.3. The Promoter reserves the right, in its absolute discretion, to verify the Winners, including but not limited to, proof of identity and/or age, as required or refuse to award a prize or to withdraw Prize entitlement and/or refuse participation in the Promotion where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this Promotion’s entry requirements or otherwise where a participant has gained an unfair advantage in participating in the Promotion or has won using fraudulent means.

7.4. By entering the Promotion, you agree to release the Promoter from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Promotion or with the acceptance, possession, attendance at or use of the Prize (except death or personal injury caused by the Promoter’s negligence, for fraud, or otherwise as prohibited by law).

7.5. In all aspects of this Promotion the Promoter’s decision is final and no correspondence will be entered into regarding the Promotion.

7.6 Co-operative Group Limited are not the Promoter and shall not be liable for any breaches of these terms and conditions by the Promoter.

7.7. These Terms and Conditions shall be interpreted and applied on the basis of English law and the courts of England and Wales shall have exclusive jurisdiction.
