GUEST WI-FI TERMS AND CONDITIONS OF USE
Please read the following important terms and conditions (“Terms and Conditions of Use”) before you access and use Co-op’s guest wi-fi service. They set out important information about your and our rights and obligations. If you do not agree to these terms, you may not access and use the free wi-fi service. We may make changes to these terms from time to time, so we recommend that you review these regularly.
Some of the free wi-fi services may be subject to additional terms and conditions we specify from time to time. Your use of this free guest wi-fi service is subject to those additional terms and conditions, which are incorporated into these Terms and Conditions of Use by reference.
By using the Co-op’s free wi-fi service you confirm that you accept these Terms and Conditions of Use. You acknowledge that you have read and understood the Terms and Conditions of Use and agree to be bound by them.
1 About us
1.1 We are the Co-operative Group Limited, a registered society in England with registered number 525R. Our registered office is at 1 Angel Square, Manchester, M60 0AG.
2 These terms
2.1 In these terms, “we”, “us” or ‘”our” or “Co-op” means the Co-operative Group Limited and, where the context requires, our subsidiaries from time to time.
2.2 When we say ‘you’ or ‘your’, we means the person accessing and using our free wi-fi service.
2.3 These terms set out the rules which govern your access to and use of the Co-op guest wi-fi service (‘free wi-fi service’).
2.4 We may use subcontractors and third party service providers to assist us in providing and updating the free wi-fi service.
3 The free wi-fi service
3.1 To access the free wi-fi service, you need a device with wireless capabilities, such as a smartphone, laptop or tablet, that has a web browser. Please check that your device is compatible before attempting to use the free wi-fi service.
3.2 The free wi-fi service is designed for typical usage, including accessing emails, browsing the internet and using apps. Activities that consume large amounts of bandwidth and data are restricted.
3.3 We may restrict access to certain content at our sole discretion and the viewing or posting of any illegal, harmful, or threatening content will be considered a serious breach of these terms.
3.4 We do not control or review the content of any website, email, or other material created or accessible over or through the free wi-fi service.
4 Our right to terminate access
4.1 If we have reason to believe that you have breached these terms (including but not limited to any breach of clauses 3.2 or 3.3), we may terminate access to the free wi-fi service immediately.
4.2 We reserve the right to suspend or revoke your access to or to stop providing the free wi-fi service at any time without prior notice to you including if we reasonably believe that:
4.2.1 your use of the free wi-fi service is unreasonably excessive
4.2.2 you are using the free wi-fi service for criminal or illegal activities; or
4.2.3 you are otherwise in breach of these Terms and Conditions of Use.
4.3 On any termination of these terms, your right to use the free wi-fi service will cease and we may terminate your access to and use of the free wi-fi service.
5 Availability and security
5.1 We cannot guarantee that the free wi-fi service will be available at any given time or at a particular speed, that access to the free wi-fi service will be free from malware, viruses, worms, trojan horses, any bugs or other types of malicious code including spyware, ransomware and/or harmful components or omissions, or that it will be uninterrupted or error-free. For example, the free wi-fi service may be temporarily unavailable while we carry out maintenance, or for other technical reasons. Where this happens, we will try to make the free wi-fi service available again as soon as the issue has been fixed.
5.2 While we take all due care in ensuring the privacy and integrity of the information you provide, the possibility exists that this information could be unlawfully observed by a third party while on free wi-fi service. You agree we disclaim all liability to you, to the greatest extent possible pursuant to law, should this occur.
5.3 The free wi-fi service is public, and the internet connection may not be secure. We recommend that you do not upload any personal or confidential information while accessing the free wi-fi service as this information may be visible to the public and may not be completely secure.
5.4 In certain circumstances beyond our reasonable control, for example where there has been a change in law, we may need to suspend or permanently cease providing the free wi-fi service.
5.5 We are not liable to you for any losses you incur as a result of any circumstances beyond our reasonable control (for example, network failures, power outages).
6 Faulty service
6.1 We will use reasonable endeavours to supply the free wi-fi service to you with reasonable care and skill.
7 Privacy and your personal information
7.1 By using the free wi-fi service you agree that your MAC (Medium Access Control) address will be stored by us. We will not be collecting or storing any personal data.
7.2 You acknowledge that in certain circumstances we might have a legal obligation to disclose this information to relevant authorities, who may interrogate the information further.
8 Collection of technical information
8.1 We may collect and use technical data that might include, for example, the speed of the wi-fi free wi-fi connection for your device in order to help us provide service updates and other services related to the free wi-fi service. You agree that we may use this information as long as it is in a form that does not personally identify you.
9 Acceptable use
9.1 You must not use the free wi-fi service to do or attempt to do any of the following:
9.1.1 break the law or solicit, encourage or otherwise be involved in or undertake any unlawful activity whatsoever;
9.1.2 view, send, receive or upload anything that is (or might be considered to be) harmful, defamatory, threatening, indecent, menacing, offensive, obscene or discriminatory;
9.1.3 infringe our or anyone else’s intellectual property rights (for example, by using or uploading someone else’s content);
9.1.4 transmit any harmful software code (such as viruses);
9.1.5 overload the free wi-fi service;
9.1.6 promote racism, bigotry, hatred or harm to any group or individual;
9.1.7 to access offensive sites containing pornographic and/or other offensive material;
9.1.8 gain unauthorised access to computers, data, systems, accounts or networks;
9.1.9 deliberately disrupt the operation of anyone’s website, app, server or business; or
9.1.10 interfere with, or attempt to circumvent, any security measures operating in relation to the free wi-fi service, including by causing any equipment used by the free wi-fi service to operate other than as intended.
9.2 You must not allow any unauthorised person to access the free wi-fi service for any purpose.
10 Changes
10.1 We may need to revise these terms at any time without further notice to you to:
10.1.1 reflect changes in the free wi-fi service;
10.1.2 deal with a security threat;
10.1.3 as a result of a change in law or guidance; or
10.1.4 without giving you any explanation or justification for such change.
10.2 You have a responsibility to read these terms prior to accessing the free wi-fi service.
10.3 Your continued use of the free wi-fi service following the updating of the Terms and Conditions of Use will mean you accept those changes.
11 External services
11.1 The free wi-fi service may enable you to access services and websites that we do not own or operate (referred to below as external services).
11.2 We are not responsible for examining or evaluating the content or accuracy of external services. Before using them, make sure you have read and agreed to the terms on which they are being offered to you, including the way in which they may use your personal information.
11.3 You must not use external services in any way that:
11.3.1 is unlawful;
11.3.2 is inconsistent with these terms or with the terms of the external services; or
11.3.3 infringes our intellectual property rights, or the intellectual property rights of any third party.
11.4 From time to time, we may change or remove external services without notice to you.
12 Our liability to you
12.1 To the extent permitted by law, we exclude all liability for any loss or damage that was not foreseeable, any loss or damage not caused by our breach or negligence, or any business loss or damage.
12.2 Nothing in these terms excludes or limits our liability for any death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or any other liability that the law does not allow us to exclude or limit.
13 Failures of networks or hardware
13.1 We rely on a number of things working properly to enable you to enjoy the service. Many of these, such as the connection speed and your device, are entirely outside of our control. Although we will do everything we reasonably can to resolve issues, we are not responsible to you if you are unable to use the free wi-fi service due to components in your device (such as a faulty internet capability) or anything else that is reasonably outside of our control.
14 Indemnity
14.1 You agree to indemnify and hold us and our subsidiaries, affiliates, officers, directors, agents and employees harmless from and against all liabilities, claims, losses or damages (including legal fees) costs and other expenses, however caused, that may arise as a result of or in connection with inappropriate or unauthorised access to the free wi-fi service by you and/or breach by you of any of the Terms and Conditions of Use.
15 General
15.1 No one other than us or you has any right to enforce any of these terms.
15.2 We may transfer our rights under these terms to another business without your consent.
15.3 If any part or provision of these Terms and Conditions of Use are found to be unlawful or unenforceable (including any provision in which we exclude our liability to you), the enforceability of any other party of these Terms and Conditions of Use will not be affected.
15.4 If we delay in enforcing our rights and remedies under these Terms, we can still enforce them later.
15.5 The laws of England apply to these terms.
15.6 Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
